In these ToS, the term “you”, “your” refers to the user or viewer of the Site and the terms “Ishaa Art Emporium”, “our”, “us”, “we” refers to Ishaa Art Emporium, a sole proprietorship concern with its registered office address at A-203, Bestech Parkview Spa Next, Sector 67, Gurugram – 122101, Haryana, India. These ToS govern your access and use of this Website.
1.2. By using our Website, you confirm that you agree to be bound by these ToS and any additional terms referred to herein. We reserve the right to make changes to the Website and update these ToS from time to time, and any changes to the Website or the ToS are effective from the date of such update on the Website. Continued use of the Website will be considered as deemed acceptance of the modified ToS.
2. Use of the Website
2.1. By using this Website, you acknowledge and represent that you are a person competent to enter into a contract under the Indian Contract Act, 1872. Your use of the Website shall be deemed an intention to enter into a binding contract, and any transaction made by use of this Website shall constitute a binding contract between you and Ishaa Art Emporium.
2.2. Any minor desirous to use or transact on this Website is required to conduct such transaction only through their legal guardian.
2.3. Ishaa Art Emporium reserves the right, at our sole discretion, to refuse to accept or process any order at any time. We may terminate our service to customers found to be using this Website and/or our services to engage in undesirable activities or otherwise violating these ToS, including termination of related account(s). You acknowledge that attempting to bypass any security features or payment gateways is a prohibited conduct.

If Ishaa Art Emporium suspects use of the Website and/or our services to be unlawful, you acknowledge and agree that Ishaa Art Emporium may take the necessary steps to prevent such continued unlawful use of the Website and/or our services, including reporting suspected unlawful activity to the relevant authorities, and dissemination of any and all account-related information to the concerned authorities.
3. Scope of Services
3.1. You will need an account before you can make any transactions on this Website.
3.2. This Website provides a platform for customers to browse and purchase physical framed & un-framed art prints and other physical art products (hereinafter referred to as the “Products”).
4. Intellectual Property Rights
4.1. Copyright Ownership: Ishaa Art Emporium retains the full copyright to all images and artwork displayed on this Website.
4.2. Purchase Restrictions: The purchase of a Product conveys ownership of the finished physical object only. It does not grant the buyer any license to scan, copy, resell, or reproduce the image for commercial or digital use. You are further prohibited from misrepresenting yourself as creator of the artwork displayed on the finished physical object.
4.3. Website Content: This Website contains graphics, photographs, images, artwork, text, fonts, and other information (referred to herein as “Information”). This Website and all Information are owned by Ishaa Art Emporium and/or our licensors, including any modifications to the Website or Information. Ishaa Art Emporium reserves all rights in this Website and Information. It is strictly prohibited to use for any purpose, reproduce, hack, or reverse-engineer any portion of the Website and/or Information. Users are strictly prohibited from using any automated system (bots, scrapers) to download any Information from the site.
5. Product Quality & Specifications
5.1. Print Variations: We use high-quality materials and professional printing processes. However, because every monitor displays colours differently, the colours of the final print may vary slightly from what you see on your screen.
5.2. Sizing: All sizes are mentioned in Height (H) x Width (W) format. All dimensions are listed in Inches. Please allow for a tolerance of 1/8th of an inch due to the manual trimming and framing process.
5.3. Limited Editions: If an art product is marked “Limited Edition,” it will be numbered and signed as described. Once the edition is sold out, no further prints of that specific size/format will be produced.
6. Payments and Pricing
6.1. Currency: All prices are listed in Indian Rupees.
6.2. Taxes: All prices are inclusive of all taxes..
6.3. Price Changes: We reserve the right to change prices at any time without notice, though the price at the time of purchasing a Product is final for that Product.
7. Shipping and Fulfilment
7.1. Production Time: Products are kept in stock as well as made to order. For Products made to order, a tentative period of 10 (Ten) business days for production is required before shipping.
7.2. Shipping Liability: All Products purchased from this Website are delivered to the buyer through our Logistics Partners. Ishaa Art Emporium does not make any warranties regarding timeline for delivery of the Products. Estimated delivery dates are purely indicative and you acknowledge and agree that Ishaa Art Emporium is not responsible for any liability under any circumstances arising out of any delay in delivery, regardless of cause of such delay.
7.3. Ishaa Art Emporium disclaims any claims or liabilities arising from any delays or and damages for goods in transit. We shall not be held responsible and will bear no liability for delays or and damages caused by but not limited to bad weather, flight delays, political disruptions, other unforeseen circumstances. Any reasonable delay beyond our control will not constitute as a deficiency of service on the part of Ishaa Art Emporium.
7.4. Any request for a change to the Product, and/or order/delivery details, subsequent to placement of order, may be entertained by Ishaa Art Emporium at its sole discretion. We shall not be responsible under any circumstances for non-execution of such change requests.
7.5. In the event that you are not available for delivery after we had made a second attempt to deliver the product, or you refuse delivery, we shall be entitled to dispose off the Products.
8. Returns, Damages, and Refunds
8.1. Damage in Transit: If your Product arrives damaged or you have received a totally wrong Product, you must notify us within 48 hours of delivery with photos of the damaged packaging and the Product. If the Product has been damaged in transit or if you have received a totally wrong Product, we will provide a replacement at no cost. Any delay in notification beyond 48 hours will not be entertained.
8.2. Return Policy: We accept returns only for the following reasons: 1) if the product is damaged in transit; and 2) If an incomplete Product is supplied due to an error at our end; and 3) If a totally wrong Product is supplied due to an error at our end. No returns will be entertained for any other reason.
8.3. Address Errors: You acknowledge that the information provided at the time of ordering shall be accurate and complete, including an accurate postal address to facilitate delivery by Ishaa Art Emporium and our logistics partners. We are not responsible for any delays, loss of shipments, misplaced shipments, incorrect deliveries, or any other loss caused due to inaccurate and/or incomplete address. There will be no refunds provided for any errors in accuracy/completeness of postal address and you will be liable to pay for the Product.
9. Indemnification
9.1. You shall indemnify Ishaa Art Emporium against all losses, costs, damages, attorney fees, etc. arising out of –
9.1.1. any breach of these ToS,
9.1.2. any breach of applicable law,
9.1.3. fraud, misconduct, misrepresentation, criminal acts, or negligence,
9.1.4. any third party action and claims arising out of your unlawful use of the Products,
9.1.5. any breach of our copyrights, trademarks, patents or other rights,
9.1.6. any breach or misuse of covenants pertaining to use of Website Information
10. Force Majeure
10.1. In no event (except for payment of money due or refunds due) shall Ishaa Art Emporium be responsible for any failure to perform its obligations related to any order or transaction due to causes beyond its reasonable control such as acts of god, war, riots, embargoes or acts of civil or military authorities, including any conditions or limitations imposed by logistics partners. In case of such events, we will inform you if any delay or order cancellation is anticipated. We will use commercially reasonable efforts to ensure such event is ended and orders are fulfilled, however, we will not be liable for any liability arising from non-delivery or delay of such orders.
11. Limitation of Liability
11.1. To the maximum extent permitted by law, Ishaa Art Emporium shall not be liable for any special, direct, indirect, incidental, or consequential damages resulting from the purchase or use of our Products. Our total liability is limited to the purchase price of the item in question.
12. Data Privacy and Use
12.1. Ishaa Art Emporium is responsible for collecting, using and disclosing your personal information in connection with your use of this Website and any order or transaction placed with us. By using this Website and/or creating an account, you acknowledge and agree that Ishaa Art Emporium will use your personal information for provision of services. Further, by placing an order you acknowledge and agree that Ishaa Art Emporium may share your personal information with its logistics partners.

14. Dispute Resolution
14.1. Jurisdiction and venue for any suit or action in relation to these ToS and any order or transaction made using this Website shall exclusively be the courts of Delhi, India.
14.2. We are committed towards ensuring that disputes between the Parties are settled amicably.
14.3. In the event of any dispute related to any order or transaction placed via our Website, prior to filing any lawsuit, you and Ishaa Art Emporium, shall first endeavour to settle such disputes through discussions for a minimum of 30 (thirty) calendar days.
